1. Agreement to Terms

By accessing or using Par The Course ("the Service"), operated at parthecourse.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service.

We may modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.

2. Description of Service

Par The Course provides AI-powered golf course strategy guides. Our Service analyzes golf courses and generates personalized hole-by-hole strategy recommendations based on user-provided information such as club distances and playing preferences.

The Service is provided for informational and entertainment purposes only. Strategy recommendations are generated by artificial intelligence and should not be considered professional golf instruction or advice.

Fair Use & Generation Limits

The Service is intended for reasonable personal use. We reserve the right to impose limits on the number of strategy guides that may be generated per account within a given time period. Excessive or abusive generation patterns — including but not limited to mass-generating guides for large numbers of courses, creating multiple accounts to bypass limits, or generating guides on behalf of third parties at scale — may result in throttling, suspension, or termination of your account.

3. User Accounts

To access certain features of the Service, you may be required to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Immediately notify us of any unauthorized use of your account

You must be at least 13 years of age to create an account and use the Service. By using the Service, you represent that you meet this age requirement.

Your account is for your individual use only. You may not share your login credentials with others, allow multiple individuals to use a single account, or create multiple accounts to circumvent any limitations or restrictions of the Service. We reserve the right to suspend or terminate accounts that we reasonably believe are being shared or misused.

4. User-Provided Content

You may provide information to the Service, including but not limited to golf club distances, playing preferences, course selections, and contact information ("User Content"). You retain ownership of your User Content.

By submitting User Content, you grant Par The Course a non-exclusive, worldwide, royalty-free license to use, process, and analyze your User Content solely for the purpose of providing and improving the Service. This license terminates when you delete your User Content or account.

You represent and warrant that:

• You have the right to submit the User Content you provide
• Your User Content does not violate any third party's rights
• Your User Content complies with these Terms and all applicable laws

5. Intellectual Property & Content Licensing

The Service and its original content (excluding User Content), features, and functionality are owned by Par The Course and are protected by copyright, trademark, and other intellectual property laws.

The Par The Course name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Par The Course. You may not use these marks without our prior written permission.

Generated Strategy Guides ("Booklets")

Par The Course provides generated course strategy guides (referred to as "Booklets") free of charge for your personal, non-commercial use only. While the Service is free to use, all Booklets and their contents remain the intellectual property of Par The Course. You are granted a limited, non-exclusive, non-transferable, revocable license to view and use Booklets solely for your own personal golf strategy purposes.

You may not:

• Edit, modify, alter, or create derivative works from any Booklet or its contents
• Resell, sublicense, rent, lease, or otherwise commercialize any Booklet or its contents
• Redistribute, republish, or share Booklets for commercial gain or public distribution
• Remove, obscure, or alter any copyright notices, branding, or attribution within Booklets
• Claim authorship or ownership of Booklet content
• Use Booklet content to create competing products or services
• Reproduce Booklet content by any means, including screenshots, photographs, screen recordings, or manual transcription, for the purpose of redistribution or commercial use

Commercial Use & Partnerships

6. Prohibited Uses

You agree not to use the Service to:

• Violate any applicable law, regulation, or these Terms
• Infringe on the rights of others, including intellectual property rights
• Transmit any malicious code, viruses, or harmful data
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers connected to the Service
• Collect or harvest user information without consent
• Impersonate any person or entity or misrepresent your affiliation
• Use the Service for any commercial purpose without our authorization
• Resell, redistribute, or commercially exploit generated content

Automated Access & Data Extraction

Without limiting the generality of the above, you may not:

• Use any robot, spider, crawler, scraper, or other automated means to access the Service or extract data from it
• Programmatically scrape, mine, harvest, or extract any content, data, or information from the Service, including but not limited to course data, strategy content, or Booklet contents
• Build or populate a database, dataset, or repository by systematically downloading or copying content from the Service
• Use scripts, browser extensions, or any other tools to automate interactions with the Service beyond normal individual use
• Access the Service through any automated interface (such as an API) that is not officially provided by Par The Course
• Circumvent, disable, or interfere with any rate-limiting, access controls, or security features of the Service
• Mirror, frame, embed, or reproduce any portion of the Service on another website, application, or platform
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or underlying technology of the Service

AI & Machine Learning Restrictions

You may not use any content from the Service, including generated Booklets, course data, strategy text, imagery, or any other materials, as training data or input for any artificial intelligence model, machine learning system, large language model (LLM), or similar technology. This prohibition applies regardless of whether the use is commercial or non-commercial.

We reserve the right to take technical measures to detect and prevent automated access, scraping, and data extraction. Violations of this section may result in immediate termination of your account and access, and we reserve the right to pursue all available legal remedies including injunctive relief and damages.

7. Third-Party Services

The Service may integrate with or utilize third-party services, including but not limited to:

• Resend: For email delivery and notifications
• Twilio: For SMS notifications (if opted-in by user)
• Supabase: For data storage and authentication
• AI/ML Providers: For generating course strategy content

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the content, privacy policies, or practices of any third-party services.

8. SMS Notifications

If you opt-in to receive SMS notifications, you agree to:

• Receive text messages related to your strategy generation status
• Standard message and data rates from your carrier may apply
• You may opt-out at any time by replying STOP to any message

9. Disclaimers

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• The quality of any strategies or content will meet your expectations
• Any errors in the Service will be corrected

Golf Strategy Disclaimer: The course strategies generated by our Service are for informational purposes only. They are AI-generated recommendations and should not be considered professional golf instruction. Always use your own judgment when playing golf and follow all course rules and safety guidelines. Your actual results may vary based on weather, course conditions, personal ability, and many other factors.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAR THE COURSE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your use or inability to use the Service
• Damages resulting from any content obtained from the Service
• Damages resulting from unauthorized access to your account or data

In no event shall our total liability exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Par The Course and its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third party's rights
• Your User Content

12. Copyright Infringement & DMCA

We respect the intellectual property rights of others and expect our users to do the same. If you believe that any content on the Service infringes your copyright, you may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by providing the following information in writing to our designated agent:

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
• Identification of the copyrighted work claimed to have been infringed
• Identification of the material that is claimed to be infringing and its location on the Service
• Your contact information, including address, telephone number, and email address
• A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
• A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

You may terminate your account at any time by contacting us at info@parthecourse.com. Upon termination, your right to use the Service will immediately cease.

Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Par The Course regarding the Service and supersede any prior agreements.
